L’art. 393 to c.p. It provides for a ground of justification based on the right of citizens to react arbitrary aggression of its rights perpetrated by public officials or public service by the Distributor or the civil servant, which can also be applied in the putative hypotheses referred to in the art. 59, co. 4, c.p., when the subject has attached concrete data, supporting one's reasonable belief that one has found one, due to an error in the matter, when faced with a situation that, if effective, would have constituted an arbitrary act of the public official (Cass. 4457/18).
